Commercial restricted use

You are not allowed to:

• make the Data available for download or disclose, provide, publish, sell, license or otherwise make available the Data or Outputs by any means to any third party; or
• commercialise, sell, license or otherwise trade in the Data or, other than for the Permitted Use, any Outputs.

You may :

• use the Data to prepare or create Output;
• publish or make available the Outputs to third parties provided that the Outputs must not reproduce significant tranches or the full set of the Data or provide, or have the effect of providing, all or a substantial amount of the Data to those third parties or otherwise allow the extraction or reverse engineering of the Data. 

As examples, you are allowed to use the data for commercial business use for a single project, such as providing consultancy services; undertaking commercial or commercialisable research (including for publicly funded research); internal commercial business purposes. 

You agree :

• that the Data constitutes commercially sensitive information of NIWA;
• that all Intellectual Property Rights in or associated with the Data are, and will remain, vested solely in NIWA;
• to take all necessary and reasonable steps to protect the Data from unauthorised access, use or disclosure.
